2. Scope of Application
These Terms & Conditions apply to all orders placed via vanilis-mg.com.
The website and all offers are directed exclusively at business customers (entrepreneurs acting in the course of their commercial or professional activity).
Only vanilla bean samples (Bourbon vanilla) may be ordered via the website.
3. Contracting Party
The contracting party is VANILIS SARL, as identified in Section 1.
4. Conclusion of Contract
The presentation of sample products on the website does not constitute a legally binding offer, but an invitation to submit an order.
By submitting an order, the customer makes a binding offer to purchase samples.
A contract is concluded once VANILIS SARL confirms the order or dispatches the samples.
5. No Right of Withdrawal
This website is intended exclusively for business customers.
Business customers are not entitled to a statutory right of withdrawal.
A business customer is any natural or legal person acting in the exercise of their commercial or self-employed professional activity.
6. Sample Limitations
Maximum quantity per shipment: 2 kg of vanilla beans
Maximum quantity per recipient address: 5 kg per calendar year
Samples are shipped from Madagascar.
The customer is solely responsible for compliance with all customs, import and regulatory requirements in the destination country.
7. Prices and Shipping Costs
All prices are stated in EUR.
Orders above EUR 100: shipping included
Orders below EUR 100: shipping costs as displayed during checkout
Delivery Terms
Delivery is made DAP (Delivered At Place).
All import duties, taxes and customs clearance costs are borne by the customer.
8. Payment Terms
Payments are due in EUR and processed via Vanilla Pay International.
Accepted payment methods include PayPal and Stripe.
9. Delivery and Delivery Time
Delivery to Europe typically takes 4–7 business days from dispatch.
Delivery times may vary due to customs clearance and external factors beyond VANILIS SARL’s control.
Delivery times are indicative only and do not constitute guaranteed deadlines.
10. Retention of Title
All samples remain the property of VANILIS SARL until full payment has been received.
11. Warranty and Liability
Samples are provided for evaluation purposes only.
VANILIS SARL provides no warranty regarding suitability, fitness for purpose or further use of the samples.
Liability is limited to intent and gross negligence.
In cases of slight negligence, liability applies only in the event of breach of essential contractual obligations and is limited to foreseeable damage.
The customer bears full responsibility for import, customs clearance and use of the samples.
12. Data Protection
Personal data is processed in accordance with applicable data protection regulations.

13. Governing Law and Jurisdiction
These Terms & Conditions are governed by the laws of the Republic of Madagascar, excluding the UN Convention on Contracts for the International Sale of Goods (CISG).
For business customers, the place of jurisdiction is Antananarivo, Madagascar.
